This Waiver and Terms and Conditions should be read in conjunction with Part 3 of the Body Control Pilates registration form that all Clients must complete before attending a group or private class either electronically or a paper copy.

I acknowledge I am aware of the risks when participating in Pilates classes (mat or equipment) offered by The Pilates Gym (“TPG”), including that the class requires physical exertion which may cause physical injury.

I will make every effort to comply with instruction offered by TPG’s teachers and will ask for clarification if needed. If I feel any pain I will cease the movement being undertaken immediately.

I will ensure I have sought medical advice (e.g. GP) before participating where I have a medical concern/problem or health-related question. I understand TPG is not a substitute for medical care.

I agree to hold TPG entirely free from any liability, including financial responsibility for injuries incurred, regardless of the reasons and circumstances. I hereby release and hold harmless TPG from any and all claims, demands, damages, costs or expenses (including legal fees), rights or causes of action, present and future, arising out of or connected to my participation in classes at TPG or use of TPG’s equipment and facilities including liability for personal injuries, health issues, loss or death.

Terms and Conditions – The Pilates Gym

If you do not agree with these Terms and Conditions, please do not participate in our classes. We reserve the right to change, update or reissue these Terms and Conditions at any time.

Definitions

  • “TPG” meaning The Pilates Gym 2025 Ltd trading as The Pilates Gym located at Heath Farm, Alcester Road, Wythall, B47 6AJ.
  • “Client” meaning any person (minimum 18 years of age) that has completed the Body Control Pilates registration form (either electronically or in writing) who pays for and attends Pilates classes (group or private) at TPG.
  • “Group class(es)” meaning a number of Clients undertaking Pilates at various advertised levels on the mat or on the equipment as per TPG class schedule.
  • “Private class(es)” meaning Clients undertaking Pilates individually or with another or others, not advertised as part of TPG group class schedule (typically no more than 4 Clients in total) organised with a Teacher, or attendance at a 1:1 assessment prior to joining group classes.
  • “Teacher” meaning the individual teaching the Pilates group class or private class.

1. Classes, Payment Terms and Cancellation

  1. No walk ins are available. All bookings must be made with a Teacher or via the electronic booking system beforehand.
  2. A Client may not join an existing group class without a compulsory 1:1 assessment with a TPG teacher.
  3. A Client may not attend a group or private class without payment. Payments are non-refundable.
  4. Prices will be communicated via TPG emails, the booking system, website or social media and may vary from time to time.
  5. We reserve the right to change the schedule with reference to the Teacher at any time without notifying Clients.
  6. You acknowledge that Teachers may use tactile curing and adjustment methods, or make physical contact with you or correct purposes to ensure Pilates practice is undertaken in accordance with best practices.

Group classes – Purchasing courses

  1. Group classes are offered in courses (typically 6 to 8 weeks) at a discounted price as communicated to you electronically by TPG before the beginning of each course. Payment is required in advance of attending the first group class of the course. Courses of group classes can be purchased via TPG (email) or via the electronic booking system.
  2. Clients who attended a previous course of classes will have priority booking to attend the next course of classes (same day/time) once the dates are released.
  3. Clients will be given a deadline where priority booking ends and if you have not made your booking by this date, we cannot guarantee your space will be saved.
  4. Using the electronic booking system will allow you to manage your course of classes. If you are unable to attend a class, you can cancel your attendance out of the class(es) (at least 12 hours before the scheduled class time) and receive a credit (refund package) to join another class of the same level which must be used within the existing course (subject to availability). Bookings for drop in classes open 7 days prior to the scheduled start time. For the avoidance of doubt, it is your responsibility to organise an alternative class via the electronic booking system. Any unused credits (refund package(s)) will be cleared from your electronic booking account at the end of each course that the credit was received in.
  5. If you have manually booked your block of classes via TPG (email) then, provided we are given 12 hours notice before your scheduled class time of your non-attendance, you may contact TPG to organise your attendance in another class of the same level which must be used within the existing course (subject to availability). For the avoidance of doubt, it is your responsibility to contact TPG if you wish to attend an alternative class.
  6. No further credits/offers to join another class will be provided if you fail to attend the reorganised class (referred to in clauses 1.9 and 1.10 above).
  7. If you know you are unable to attend 1 or 2 classes in a course (e.g. due to holiday) you are able to pay for the course minus the cost of the 1 or 2 classes you are unable to attend. If booking was made via the electronic booking system using a discount code, you must cancel your attendance from the 1 or 2 classes you are unable to attend immediately upon booking the course.
  8. If you are unable to attend 3 or more classes in a course, we may ask you to pay for classes you will not be able to attend in order to retain your priority booking access for subsequent courses.
  9. Credits/missed classes cannot be carried forward into the next course and no refund will be due. Any credits (refund packages) showing on your electronic booking system will expire at the end of each course despite the credit displaying 10 week expiry date (and you will receive email notification of the removal of the credit from your online account).

Ad hoc classes

  1. Provided you have completed a compulsory 1:1 assessment at TPG, you may join ad hoc classes (as an alternative to purchasing a course) which are bookable via the electronic booking system at the advertised rates. You must join a class applicable to your level, which can be discussed with TPG.
  2. No credits will be provided via the electronic booking system and no refund will be due if you do not attend the booked class(es).

Private classes (or assessments)

  1. Typically these will be organised via electronic communication with the relevant TPG teacher (but may also be purchased via the electronic booking system).
  2. Payment must be received at least 24-hours before the scheduled private class or assessment.
  3. If a Client needs to cancel their attendance in a private class or assessment then it will be reorganised for a date/time convenient to the Teacher. For the avoidance of doubt, if the Client does not agree to the new dates/times offered there will be no refund provided.

Gift vouchers

  1. Gift vouchers sold by TPG from time to time are non-refundable. Any gift vouchers given away for free as part of marketing or promotional campaigns are not redeemable for cash. TPG bears no responsibility for loss or theft of gift vouchers. All gift vouchers have a strict expiry date. Unredeemed balances on gift vouchers are not refundable.

2. Lateness

  1. TPG has a strict late arrival policy so please ensure you arrive at least 5-minutes ahead of the planned start time of your group or private class.
  2. In the event that a group class begins but all registered Clients have not yet arrived, the door of TPG will remain unlocked for 5 minutes after the confirmed start time. After a 5-minute discretionary period, the front door will be locked and Clients will not be permitted to join the group class.
  3. If a Client is late to a private class, the session will not be extended and will end at the appointed time.
  4. If a Teacher is late, additional time will be added to the class or a subsequent class.

3. Health

  1. By attending TPG classes, you will be performing physical activity and exercise which has an inherent risk of personal injury. You acknowledge participating in Pilates is undertaken at your own risk.
  2. You must inform Teachers if there are any risks to your health by participating in Pilates, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement. Participating in any form of exercise at TPG with a Medical Condition is done entirely at your own risk.
  3. You must inform your Teachers prior to each class whether there are any changes to your health since your last attendance in class.
  4. If it is not your regular Teacher, you must ensure they are informed of the information set out in Clause 3.2 above.
  5. Clients may be asked to re-complete the Body Control Pilates registration form from time to time to have a written record of changes in health. If there are known changes to health, Clients should request a copy of their form to update the answers.
  6. TPG Teachers are not medically trained and are therefore not qualified to assess whether clients are in good physical condition and/or that Clients can engage in exercise without detriment to their health, safety, comfort or physical condition. Clients are advised to seek medical advice prior to commencing any exercise program if you have suffered from an illness or injury or are in any doubt about their ability to engage in exercise.

4. Client obligations

  1. TPG reserves the right to refuse entry to, or eject Clients or others who are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner, or in any manner which may threaten the safety of other Clients or Teachers. This also applies to clients who abuse the use of discount codes or credits (refund packages) offered via the electronic booking system). TPG also reserves the right to refuse entry to any Client if it considers the health of the Client concerned may be endangered by taking part in a class.
  2. Smoking is forbidden inside TPG at all times.
  3. Clients are required to treat other Clients, Teachers, others and property at TPG with all due care and respect and follow Teachers’ instructions.
  4. Clients are required to wear appropriate attire for physical exercise at all times while visiting TPG and must refrain from wearing clothing which contains offensive prints or designs or which may present a danger to themselves.
  5. For hygiene purposes, socks must be worn at all times. Grip socks must be worn for group and private classes using the equipment (e.g. reformer).
  6. Please ensure all mobile phones are on silent during classes.
  7. No photos or videos are allowed to be taken by Clients of other Clients or Teachers without their prior consent.
  8. Children, dependents, or guests of a Client are not entitled to entry inside TPG premises unless attending postnatal classes, or a specific arrangement has been made with a Teacher.
  9. Only water is permitted into TPG’s studios during classes.
  10. If you’re unwell or experiencing symptoms of the flu, cough, cold, or any illness, please do not attend class. If you were scheduled for a private class this will be rescheduled with your Teacher. If you were attending a group class, we will endeavour to allow you to join another group class of a similar level within the existing block subject to availability (therefore this cannot be guaranteed).
  11. Clients who suffer an accident or injury at TPG premises must report the accident or injury to a Teacher immediately following the accident or injury.

5. Pregnancy

  1. It is a Client’s responsibility to inform their Teacher of their pregnancy. TPG will advise which group classes are suitable for continued attendance or which Teachers can teach private classes.
  2. Certain group classes (as advised by TPG) are suitable for women to attend to up to 30 weeks of pregnancy provided you were attending regular Pilates classes before becoming pregnant. However you must take into account it is inadvisable to do Pilates between weeks 8 to 14 of pregnancy.
  3. Once pregnancy reaches 30 weeks it is requested that you attend private classes.
  4. Clients that participate in any exercise program, while pregnant may increase the risk of injury to themselves and, if applicable, to their unborn child. You acknowledge participating in Pilates is undertaken at your own risk and you have obtained medical consent to attend class.
  5. You should not return to Pilates classes until 6-weeks postpartum and only once you have received medical consent.
  6. Clients who attend TPG classes during or after pregnancy understand the exercises you perform must be determined by yourself in consultation with medical professionals. Clients should cease all activity immediately if you feel any discomfort and shall immediately contact their GP/midwife/physician as appropriate to seek advice. Teachers at TPG are not medical professionals.

6. Personal belongings

Personal belongings are brought onto TPG’s premises at the Client’s own risk and TPG does not accept liability for any loss or damage whatsoever to such items. We suggest you bring only any personal belongings into TPG premises which are absolutely necessary for the purpose of your visit. TPG is not responsible in any way for any vehicle (and its contents) parked on the car park outside of TPG’s premises.

7. Photography

Photographs or videos may be taken by the Teacher for promotional purposes and utilised on TPG’s social media channels, website and other promotional outlets as appropriate (for example (but not limited to) paper flyers). If you do not consent to TPG using still images or videos taken during a group or private class for promotional purposes, please notify TPG in writing.

8. Data Protection

Personal information collected by TPG will be used in accordance with these Terms and the statements on the Body Control Pilates registration form that all Clients complete before attending a group or private class and in accordance with the General Data Protection Regulations (UK GDPR) and Data Protection Act 2018.

9. Limitation of Liability

Except for any liability that cannot be excluded by law, TPG (including its Teachers, officers, employees and agents) excludes all liability (whether under the law of contract, tort or otherwise), for any personal injury, loss or damage (including but not limited to loss of opportunity, loss of reputation or goodwill, loss of privacy or loss or corruption of information or data); whether direct, indirect, special or consequential, arising in any way out of your attendance at our classes. This includes but is not limited to any theft, unauthorised access or third party interference. This limitation of liability applies even if TPG has been expressly advised of potential loss.
